Washington — The House has set the stage for potentially tough congressional negotiations on mental health parity by adopting broader legislation than the Senate.
The Paul Wellstone Mental Health and Addiction Equity Act of 2007, which the House passed 268-148 on March 5, would strengthen existing law by requiring insurers to provide out-of-network mental health coverage if insurers offer out-of-network physical health benefits. Washington — Bills to protect Americans from misuse of their genetic information and to prevent discrimination in mental health benefits attracted broad support last year but still face a tough road this year because of unresolved disputes.
Both the Genetic Information Nondiscrimination Act of 2007 and the House and Senate mental health parity bills have an array of co-sponsors and support. All of the measures, except the House mental parity measure, were approved by one chamber of Congress last year.

The U.S. Sentencing Commission has issued new guidelines that reduce average sentences for crack-cocaine offenses and bring penalties more in line with those meted out to offenders caught selling or possessing powdered cocaine, the New York Times reported Nov. 2.
After years of debate over the sentencing disparity*, the sentencing panel quietly reduced the average crack sentence from 10 years, 1 month to 8 years, 10 months. Congress let a mandatory 180-day review period pass without challenging the commission’s recommendation.

The addiction and mental-health parity bill has been approved by the third and final committee needed to get it to a vote on the House floor, CADCA Coalitions Online reported Oct. 18.
The House Energy and Commerce Committee approved the Paul Wellstone Mental Health and Addiction Equity Act of 2007 this week. The vote means that the bill, H.R. 1424, is cleared for a vote by the full House. The measure currently has 273 cosponsors, more than enough for passage.

An addiction and mental-health parity bill has been vetoed by California Gov. Arnold Schwarzenegger, who cited concerns about the measure’s cost.
The bill, AB-423, would have barred insurers in California from enacting coverage limitations for addiction and mental illness that differ from those in force for general healthcare conditions.

The children’s health-insurance bill passed by the House and Senate this week not only raises federal tobacco taxes to pay for expanded health care but also requires state programs to treat addiction and mental-health disorders on par with physical illnesses.
The Senate voted 67-29 on Sept. 27 to approve the expansion of the State Children’s Health Insurance Program (SCHIP). The legislation would add $60 billion to SCHIP over the next five years, providing health coverage to an additional 4 million uninsured children. Currently, state-run SCHIP programs cover 6.6 million children who families have incomes too high to qualify for Medicaid but can’t afford health insurance.
