An integral part of some state and local health system reform efforts has hit a major stumbling block. The business community has taken employer mandates to court.
These state and local laws require businesses to spend a certain amount on workers’ health care coverage or put that money into a fund to provide access for the uninsured. U.S. courts in Maryland, New York and California have sided with the business community and ruled that the federal Employee Retirement Income Security Act trumps these efforts.

Washington — The Jan. 14 announcement of findings from the Enhance trial, which compared patients on the cholesterol-lowering drug Vytorin — a combination of ezetimibe and simvastatin — with a statin alone, sent shockwaves through the medical community. After all, many physicians viewed this as a promising approach in reducing heart disease risk because the drugs it combined work differently to reduce LDL cholesterol.

The Harvard Undergraduate Council continues to make grants of $100 or more that can be spent on alcohol at student parties despite a dean’s order to stop funding alcohol purchases on in-dorm events, Bloomberg News reported Oct. 15.
The grant program began in 2003 as part of an initiative to improve student social activities that also included the opening of an on-campus pub. But new Harvard interim dean David Pilbeam recently announced a cutoff in funding for parties.
