Missouri Supreme Court: Doctors can sue if hospitals ignore bylaws in privileging issues

Physicians say a Missouri Supreme Court ruling, though narrow, recognizes the significance of medical staff bylaws and offers doctors some recourse in the face of unfair discipline.

Breaking with a 43-year-old precedent, a unanimous high court opened the door for medical staff members to sue hospitals over privileging disputes if the facilities fail to follow staff bylaws. Justices departed from a long-held principle that hospital privileging decisions were not subject to judicial review, noting that was the “nationwide majority rule” at the time of the high court’s 1965 decision.

Resident Match breaks records for applicants and couples

Over a flauta and a chicken-spinach enchilada, Brandon Bolfing and Shahed “Sky” Izaddoost took a breather from their final year at the University of Texas Medical Branch at Galveston to celebrate their Match results with friends and family at a Mexican restaurant.

“This is the first place we went in medical school,” Bolfing said. “And it will be the last now that we’ve matched.”

Employer mandates hit legal snag, states continue to search for options

An integral part of some state and local health system reform efforts has hit a major stumbling block. The business community has taken employer mandates to court.

These state and local laws require businesses to spend a certain amount on workers’ health care coverage or put that money into a fund to provide access for the uninsured. U.S. courts in Maryland, New York and California have sided with the business community and ruled that the federal Employee Retirement Income Security Act trumps these efforts.

Vaccine court’s ruling adds to confusion over autism link

Washington — Physicians are being called upon, once again, to address concerns about the safety of childhood vaccines. This time families’ queries are driven by a special vaccine court’s decision to pay for the care of a young girl injured by vaccines.

The court ruled last fall that 9-year-old Hannah Poling’s underlying mitochondrial disorder was aggravated by the shots which she received as a toddler and resulted in brain dysfunction and “features of autism spectrum disorder.”
